Welcome to amazemagic.com, a website owned and operated by Starvox Entertainment and its affiliated entities (“Starvox Entertainment,” “we,” or “us”). These Terms of Use, together with our Privacy Policy, apply to all visitors, users, and ticket purchasers of the site and to guests attending our performances. Please read them carefully before using the site or attending a performance. By accessing or using the site, purchasing tickets or products, or attending a performance, you agree to be bound by these Terms. If you do not agree, do not use the site.
Age Requirement
The site is intended for adults. By using it you represent that you are at least 18 years old and legally able to enter into a binding contract. Guests under 18 need a parent's consent to use the site; guests under 16 must be accompanied at the performance by an adult 21 or older.
Agreement to Arbitrate
These Terms require that most disputes relating to the site, ticket or product purchases, or visits to our performances be resolved by binding arbitration, that (to the fullest extent allowed by law) you waive the right to participate in any class action, and that New York law governs. If you do not agree to arbitration, do not use the site or attend a performance.
Changes to These Terms
We may amend these Terms and our Privacy Policy at any time without prior notice. Updated versions will be posted with a revision date, and your continued use of the site after any change constitutes acceptance.
Accessing the Site
Access is provided on a temporary basis. We may withdraw or modify the site or any part of it at our discretion and are not liable if it is unavailable at any time. You are responsible for arranging your own access and for ensuring that anyone using the site through your connection complies with these Terms.
Ticket Purchases
- Payments. Payments are processed by third-party providers (currently KX Tickets, Stripe, and Producer360/TickX). If you pay through a service such as Apple Pay or PayPal, that provider's terms and privacy policy apply.
- Pricing errors. The site may occasionally contain typographical errors or inaccuracies. To the fullest extent allowed by law we reserve the right to refuse or cancel any order placed at an incorrect price, and to issue a credit if a payment method has already been charged.
- No resale. Tickets purchased through the site may not be resold or offered for resale by you or anyone else without our written consent and may not be resold above face value.
- Fraud. We use third-party providers to detect fraudulent transactions and may cancel orders or report fraud where permitted by law.
- Prices & taxes. Prices and applicable taxes may change from time to time and are calculated at checkout.
Ticket Terms
All tickets are non-refundable.
A ticket is a personal, revocable right of admission. Lost, stolen, or destroyed tickets will not be honored, and tickets obtained from unauthorized sources may be invalid. Admission may be refused, and ticket-holders may be removed without refund, for conduct that we determine to be disruptive or unsafe. Tickets may not be used for advertising, promotion, or other commercial purposes without our written permission.
Prohibited Uses of the Site
You agree not to use the site:
- In any way that violates applicable law or regulation;
- To exploit, harm, or attempt to harm any person;
- To transmit spam, chain letters, or other unsolicited promotional material;
- To impersonate us, our staff, or any other person or entity;
- To interfere with anyone else's use of the site;
- To attempt to disable, damage, or overburden the site or any connected system;
- To use bots, scrapers, or other automated means to access or copy the site without our written consent;
- To introduce viruses, malware, or other harmful code;
- To attempt to gain unauthorized access to any part of the site or its underlying infrastructure, including denial-of-service attacks.
At the Venue
Certain items may not be brought into the venue and may be confiscated by staff, including weapons, illegal drugs, outside food or beverages (including alcohol), cans and bottles, aerosols, indelible markers, backpacks or duffel bags, and any item staff consider inappropriate. For everyone's safety, all bags entering or leaving the venue may be inspected, and by attending you consent to a reasonable examination of your person and belongings.
Photography & Right of Publicity
By attending a performance you (and any minor in your care) may be filmed, photographed, or recorded. You grant Starvox Entertainment a perpetual, royalty-free right to use those recordings, along with your name and likeness, in any media for promotional and other purposes, without further compensation or notice. Other attendees may also take photos or video that we cannot control.
Newsletters & SMS
Purchasing a ticket or signing up on our site enrolls you in our email list unless you opt out. You may unsubscribe at any time using the link in any email or by contacting info@starvoxent.com. SMS opt-in is voluntary; message and data rates may apply, and you may text STOP to opt out. Information collected via SMS opt-in will not be sold, rented, or shared.
Accessibility
Public areas of the venue are generally accessible, though some balconies and platforms may not be. Guests requiring a support person or service animal are welcome; complimentary attendant tickets are available on request. Please contact us in advance if you have specific needs or a non-traditional service animal.
Proprietary Rights
The site and its contents — including all text, images, video, audio, trademarks, service marks, and layout — are owned by Starvox Entertainment or its licensors and protected by U.S. and international intellectual-property laws. You may not copy, modify, distribute, publish, or create derivative works from any of the material without our written permission. Any comments or suggestions you submit may be used by us without compensation or attribution.
Security
We use reasonable technical, organizational, and administrative measures to protect your personal information, but we cannot guarantee that unauthorized parties will not access it. Providing information through the site is at your own choice.
Indemnity
To the fullest extent allowed by law, you agree to defend, indemnify, and hold harmless Starvox Entertainment, its affiliates, and their employees, contractors, agents, officers, and directors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the site, your conduct at a performance, your violation of these Terms, your violation of any third-party right, or your violation of any law.
Disclaimers & Limitation of Liability
The site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, Starvox Entertainment and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, and their total aggregate liability arising out of or relating to these Terms, our performances, or the site will not exceed the amount, if any, you have paid us for the tickets or products giving rise to the claim.
Your jurisdiction may not allow some of these limitations.
Governing Law & Arbitration
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. To the fullest extent allowed by law, you and we agree to resolve all disputes through binding arbitration in New York, New York under JAMS rules, and to waive any right to a class action. Disputes about intellectual-property ownership are excluded from arbitration. Before starting arbitration, the party with a dispute must send written notice describing the facts and the remedy sought to the other party (for us, by email to marketing@starvoxent.com with a copy to info@starvoxent.com), and both parties will attempt in good faith to resolve the dispute for 60 days.
Notices
We may send notices required by law or related to our business by email, postal mail, or a conspicuous posting on the site. We reserve the right to choose the form of notice, subject to your right to opt out of certain marketing communications.
Entire Agreement; Severability
These Terms, our Privacy Policy, and any agreement to pay for tickets or products together form the complete agreement between you and us regarding the site and our performances. If any provision is found invalid, the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver of it.
